For families opting for cremation, deciding what to do with the ashes is an important next step. Scattering ashes is a popular choice, and while there are no formal regulations, there are important guidelines to follow.

Here’s what you should keep in mind:


  • If scattering ashes on private land, be sure to get written consent from the owner.
  • A permit is required to scatter ashes in public parks.
  • Ash scattering on public lands without specific regulations is allowed, but personal judgment should be used.
  • Avoid scattering ashes within 100 yards of roads or trails.
  • Dispose of the cremation container in an eco-friendly way.
  • When scattering ashes in inland waters, a permit is required under the Clean Water Act.
  • Ashes scattered at sea must be at least three nautical miles from the shore. The EPA requires notification within 30 days after the scattering. Also, any flowers or wreaths used should decompose naturally, so avoid non-biodegradable items.
